World Life Experience “ChangeMakers programs”

 

(General Conditions)

 

  1. The World life Experience, ChangeMaker Programs are organized by Top Experience, Lda., headquartered at Av. Conselheiro Fernando de Sousa 19 16º Dto - 1070-072 LISBON, also referred to in the current General Conditions as “Company”.

  2. The Company will book Participant’s Program referred to as “Programs” according to the details specified in the confirmation of booking through Partner Organizations referred to as “Organizations” that are recognized as reliable and professional.

  3. The client or Applicant referred to as “Participant” manifests the full and express consent Participant to all terms and conditions specified in the confirmation of the booking and its terms and conditions that represent the agreement between the Participant and the Company.

 

 

 

(Objectives)

 

  1. WORLD LIFE EXPERIENCE is an educational and cultural project, capable of providing the necessary social skills for volunteers to become global citizens.

  2. Our objective is to transform volunteers into global citizens through cultural education and social programs, providing unique skills to create a positive impact in their local communities contributing to greater sustainability in the world.

  3. Promoting social responsibility through hands-on involvement with local organizations and global NGOs, raising awareness of the importance of sustainability in the world.

  4. The Company undertakes to arrange the booking in a professional manner, provide the participants with the relevant information concerning the program, and ensure that the booking conforms to the details requested in the booking.

 

 

(Event Conditions)

 

  1. World Life Experience reserves the right to implement changes to the travel plan or improvements, at any moment and without prior notice, as long as such does not imperil each participant’s physical and psychological integrity, without the payment of any type of indemnification whatsoever.

  2. It is the Organization’s duty to define the rules to ensure the proper functioning of the event, namely those set forth in the regulation, at the site www.worldlifeexperience.com.

  3. The Organization shall take any measures it deems appropriate to ensure the attainment of the established standards, and, for that purpose, it may draft any additional amendments that may be deemed necessary.

 

 

(Company Liability)

 

  1. The Company is not liable for unexpected disturbances and/or malfunctions that are beyond its control if such circumstances are experienced by Non-Governmental Organizations, since the Program is offered under the sole liability of the Non-Governmental Organizations, the Company shall make every effort to help the Participant concerning any question, query or irregularity pertaining to the services. It is recognized that the World Life Experience is acting on an agency basis.

  2. All the information represented by the World Life Experience concerning the Programs is based fully upon information received from the respective Organization. The Company's liability for this information is limited and shall not incur the cost of any damage whatsoever caused as a result of a Participant undertaking the Program. 

  3. In the event of a special request made by a Participant, the Company undertakes to deliver the request to the relevant Organizations. The Company is not obligated to fulfill this request unless the Participant has received approval in writing that his request would be fulfilled. When a special request included in the booking pertains to essential requirements made by the Participant to accommodate his/her special needs, the Company shall inquire with the Organizations as to whether the aforesaid request can be fulfilled and shall notify the volunteer about its query prior to the final approval or denial of such request. 

  4. The Company may, at its discretion, reject a request to make a booking or cancel the same or discontinue the participation of a Participant that interferes with the ordinary course of the Program without having to provide a reason for its decision. In such an event, all expenses shall be incurred by the Participant. 

 

 

(Participant´s Liability)

 

  1. The Participant is obligated to inform about any physical and/or mental condition and/or any other condition that might limit or impede his/her participation in the Program when he/she is completing the program application. Any malfunction and/or expenditure caused as a result of the Participant's physical and/or mental condition shall be incurred solely by the Participant.

  2. The Participant declares and warrants that he/she understands that he/she is a part of a volunteer program. Hence, he/she will conduct him/herself with patience and tolerance towards all other Participants, cooperate and abide by the instructions in the due course of his/her relations with other Participants and towards others in general. 

  3. The Participant undertakes to appear in scheduled hours and if he/she does not do so he/she may be considered as if he/she waived his/her right to do so. If the Participant is prevented from participating for reasons that are beyond his/her control he/she must notify the World Life Experience Team or the on-site volunteer leader immediately.

  4. The Participant is responsible for all his / her actions throughout the trip, any acts of violence, disrespect or failure to comply with the rules defined by the Organization may result in expulsion from the Program without any right to reimbursement or compensation to the Participant.

  5. Some Programs may be located in dangerous areas. A Participant that disobeys the instructions provided by the site management does so at his/her own risk and sole responsibility. 

  6. The Participant is responsible for obtaining all and every appropriate vaccination, as required by each country, and for bringing his own medication to the Program, according to their needs and for confirming the legality of each medication for each destination country.

 

 

(Liability for damages)

 

  1. The Company is not liable for damages caused to the Participant as a result of falling, accidents, diseases, hospitalization, medical expenditures, damage to luggage, failure to perform certain actions or faulty execution, inconvenience or any direct or indirect damage that may be caused to the Participant during the Program.
    This includes any circumstance not within the Company's reasonable control including, without limitation:

    (a) Flood, drought, earthquake or other natural disasters.
    (b) Disease, epidemic or pandemic.
    (c) Terrorist attack, civil war, civil commotion or riots, war, the threat of or preparation for war, armed conflict, the imposition of sanctions, embargo, or breaking off of diplomatic relations.
    (d) Nuclear, chemical or biological contamination or sonic boom.
    (e) Any law or any action was taken by a government or public authority, including without limitation imposing an export or import restriction, quota or prohibition, or failing to grant a necessary license or consent.
    (f) The collapse of buildings, fire, explosion or accident.
    (g) Any labor or trade dispute, strikes, industrial action or lockouts.
    (h) Non-performance by suppliers or subcontractors.
    (i) Interruption or failure of utility service.

    It is emphasized and clarified that no refunds whatsoever shall be given for discontinuation of a Program owing to disease, injury or any other reason. The Participant shall not make any claim, pecuniary or other against the World Life Experience, its employees, agents, representatives or anyone acting on its behalf. The conditions set forth herein are binding and no one, including anyone acting on behalf of the World Life Experience, is authorized to act in a manner different than the one stipulated herein. 
    The Company and/or its representatives are not liable for monetary losses and/or additional losses that are caused due to changes or cancellations and/or due to delays. These losses and/or expenditures shall be borne solely by the Participant.

 

 

(Accommodation)

 

  1. Varied living conditions are provided among Programs. Accommodation may be in dorm-style rooms with western-style shared or en suite bathroom and showers, in private rooms or with local families in a style customary to the region.  In addition, certain Programs provide prepared meals for Participants and in other Participants receive food and prepare the meals themselves.

 

 

(Passports and Visas)

 

  1. The Participant is responsible for obtaining a valid passport and extending its validity, as needed. The passport should be valid for at least 6 months from the date of Program completion and departure. The Participant is responsible for checking all exit and entry requirements of any area traveled to/from before undertaking and whilst undertaking the Program. The Participant is responsible for payment of fees, charges, and handling fees for issuance/extension of passport and issuance of entry visas. The Participant is hereby notified that in the event that he/she does not obtain the proper visa to enter each country, he/she bears full liability concerning such matters. The Participant is not obligated to specify whether he/she holds more than one passport. 

 

 

(Prices)

 

  1. Program prices are advertised in Euros (EUR) and US Dollars (USD), in each program terms and means of payment may vary from NGO to NGO.

  2. Failure to transfer the balance payment by the due date allows the Company to consider that the booking has been canceled, according to its sole discretion. Under these circumstances, refunds, if any, will be given in accordance with the cancellation policy.

 

 

(Insurance)

 

  1. Your safety and security are our priorities, travel insurance is important if something unexpected happens such as a personal injury, a flight issue or a related scenario. Travel insurance is optional, however, we strongly recommend you to be cover for the duration of your trip. 

 

 

(Health and vaccinations))

 

  1. The Participant must notify the Company regarding any physical and/or mental limitations and/or any other limitation that may impede their participation in the Program. Any pregnant woman is obligated to furnish a medical confirmation in English regarding her condition, including approval to fly, and in any event, her permission to fly is at the discretion of the airline company. The Participant is responsible for obtaining all and every appropriate vaccination, as required by each country, and for bringing his own medication to the Program, according to their needs and for confirming the legality of each medication for each destination country.

 

(Natural phenomena, weather, and force majeure)

  1. The Company is not responsible for any climatic phenomena (floods, fog, clouds, etc.) and/or any other circumstances that are beyond its control and that may cause any change or cancellation. The Company shall be exempt from liability towards the Participant for any claims related to cancellation and/or change in any time that are a result of force majeure strikes, disturbance of public peace, fire, inundation, weather conditions, civil revolt, war, acts of terrorism, military operations, invasions, rebellion, pandemics, volcanic eruption, disease, robbery, theft, boycott, arrests, technical malfunctions, or any similar event caused by a force majeure.

(Program Application)

 

  1. For the purposes of formalizing the application, the Participant must purchase their ticket associated with the 15-day program. The ticket is required to book and secure the seat in the program in question, the reservation is only effective after payment of the ticket.

  2. The ticket is valid for each 15-day program, periods of 30 days or more at the same destination implies the payment of a ticket for each 15 day period.

  3. In case of cancellation by the Participant, the ticket may be refunded within 15 days of purchase and is valid for 1 year to be used.

  4. In the event of cancellation by the organizing organization of the program, the ticket may be used later for a period of one year or may be refunded in full excluding payment fees.

 

 

(Terms of payment)

 

  1. The balance payment does not include any money transfer commissions which may be incurred through the different payment methods. Participants are responsible for all incurred bank charges. All the payment methods available and details from the program Organization will be sent in the confirmation email.

  3. In the event of cancellation, return payment will be made in the same manner it was initially received, in accordance with the cancellation policy stated below, excluding any fees incurred for transactions.

 

 

(Ticket Payment)

 

  1. After the Participant receives the program details, he/she should purchase a ticket corresponding to the respective program in order to formalize and guarantee the placement in the experience, the ticket costs €50 and is included in the program total costs.

  2. The ticket payment is required, the remaining balance is required upon the stated deadline, as specified and paid directly to the program Organizers.

 

 

(Ticket Cancelation)

 

The Participant may cancel the ticket in writing according to the following terms:

  1. If the cancellation is within a period of no more than 15 days after the ticket purchase, the Participant has the right to be reimbursed 100% of the ticket value.

  2. If the cancellation is more than 15 days after the purchase of the ticket, it is not susceptible to return however it is valid for 1 year to be used.

(Ticket Changes)

 

Participants may change their order in writing according to the following terms:

  1. Any changes made by the participant must be communicated 30 days prior to the start of the program to ensure the time required for the changes.

  2. Any request for change within 30 days may result in Company and Partner Organizations not approving the change.

  3. Changes will only be considered valid as long as they are approved by the Partner Organizations responsible for the program concerned.

(Ticket Return of Payment)

  1. The payment return will be made in the same manner it was initially received, in accordance with the cancellation policy stated below, excluding any fees incurred for transactions.

(Program Payment)

 

  1. Payment of the remaining amount of the program (excluding the ticket) is made directly to the Organization where the volunteering will take place.

  2. Payment is made in accordance with the specifications and available means of each Partner Organization made available in the submission of the details of the same.

(Program Cancellation)

 

The Participant may cancel the program in writing according to the following terms:

  1. 30 days or more days before departure – Participant forfeits remaining payment;

  2. 15 days before departure – Participant forfeits 50% of the remaining payment;

  3. and within 5 days before departure or no-show – Participant forfeits 100% of the remaining payment.

 

 

(Program Return of Payment)

 

  1. The payment return will be made by the Organization, in the same manner, it was initially received, in accordance with the cancellation policy stated below, excluding any fees incurred for transactions.

(Applicable Law and Competent Court)

 

  1. Participants expressly and unequivocally agree that these Terms and Conditions are subject to the regulation of the Portuguese Law, expressly disclaiming the applicability to it of any other legal, regulatory or conventional provisions of Law.

  2. Without prejudice to access to the relevant judicial channels, in the event of claim and relief for disputes of a value no greater than the threshold value for courts of the first instance, on the grounds of non-compliance, by Top Experience Lda., as set out in the applicable legislation, Top Experience Lda. offers the Customer access to the [Centro de Arbitragem de Conflitos de Consumo, Rua dos Douradores, 116, 2º andar, 1100-207 Lisboa]. More information at "Portal do Consumidor" (www.consumidor.pt).

  3. In order to resolve any dispute arising from the execution or interpretation of these Terms and Conditions, the participants consider the Portuguese Law as applicable and specify as competent the Civil Court of the District of Lisbon, with express waiver of any other.

 

 

(Omissions and Issues of Interpretation)

 

  1. All omissions and issues of interpretation in connection with these Regulations must be submitted to the following email address: support@worldlifeexperience.com

  2. The promoters of the event are exclusively responsible for resolving the issues and omissions provided for in the preceding paragraph and shall be disclosed by the means deemed most convenient.

(Acceptance and Confirmation)

 

  1. I, the undersigned, undertake to pay the Company for the order of services in accordance with these terms and conditions specified hereinabove in this confirmation of order and the terms and conditions of order that were delivered to me and/or that are published in the Company's internet website: https://www.worldlifeexperience.com/terms-and-conditions-programs, and which I read thoroughly and approved including all conditions and limitations specified therein.
